Indeed, with a recent kernel (2.6.32) AND hostapd it works flawlessly
_without_ any patches

All access point configuration is now done in hostapd

I certainly works with my Atheros card:
# lspci
00:11.0 Ethernet controller: Atheros Communications Inc. Atheros AR5001X+ 
Wireless Network Adapter (rev 01)
# lspci -n
00:11.0 0200: 168c:0013 (rev 01)
